1. Agreement to Terms

These Terms of Use ("Terms") are a legal agreement between you and Kani Media Company LLC ("we", "us", or "our"), the operator of Wingu9. By accessing or using the Wingu9 mobile application, website, and services (the "Service"), you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Wingu9 provides weather intelligence, live camera streams, farm AI recommendations, alerts, and related agricultural information for users in Kenya and beyond. The Service is provided for informational and decision-support purposes. We do not guarantee specific outcomes, yields, or profits from using our recommendations.

3. User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information, and you must be at least 13 years old to use the Service.

4. Subscriptions and Billing

Wingu9 offers free and premium subscription tiers. Premium features require payment through Stripe, M-PESA, or in-app purchases. All payments are processed by third-party providers subject to their own terms. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel, upgrade, or downgrade through your account or billing settings.

5. Intellectual Property

All content, software, designs, trademarks, and data in the Service are owned by Kani Media Company LLC or its licensors. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our written permission.

6. Limitation of Liability

To the fullest extent permitted by law, Kani Media Company LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Agricultural decisions are your own responsibility, and weather forecasts and AI recommendations are provided without warranty.

7. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if required by law. You may stop using the Service at any time. Upon termination, your rights to use the Service will immediately cease.

8. Governing Law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved in the courts of Kenya.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
